Privacy Statement – ClauseBase communications

ClauseBase is operated by ClauseBase BV, with registered office at Alfons Stesselstraat 9, 3012 Wilsele, Belgium and registered with the Crossroads Bank for Enterprises under company number 0723.768.270 (hereafter: “ClauseBase” or “we”).

This Privacy Statement explains how ClauseBase, as the data controller, uses any personal information about you when we are engaging in communication for potentially doing business together.

1. When does this privacy policy apply?

This privacy policy applies when we get in touch with you to explore opportunities for working together.

2. Which personal data do we process and why?

2.1 Contact data

In order to be able to reach out to you effectively to offer you potentially interesting tools to augment your legal drafting workflow, we collect information such as your name and email address. This information is collected through publicly available sources or by direct communication with you.

We rely on our legitimate interest to process this data in order to be able to proactively communicate to you our legal drafting tools. In doing so, we hope to offer you the choice to determine whether this could be beneficial to you and continue the communication or not.

2.2 Professional data

We try to limit communications that have not been initiated by you. When we are getting in touch directly, it means we have leveraged publicly available information (e.g.: social media) to make sure you could benefit from the offer we communicate to you and that this is relevant to you. For that, we process personal data such as your job title and the name of your employer.

We rely on our legitimate interest to process this data in order to be able to proactively communicate to you our legal drafting tools. In doing so, we hope to offer you the choice to determine whether this could be beneficial to you and continue the communication or not.

3. How long do we store your personal data?

All personal data we collect through our interactions with you will be retained for as long as necessary to communicate with you, but also to maintain a historical record of our communications. This allows us to return to previous communications when you come back to us with new questions, requests, comments or other input.

4. What are your rights in relation to your personal data?

Access right: You have the right to access your personal information processed by us.

Right of rectification and the right to erasure: At all times, you have the possibility to rectify or erase your personal data, provided that the applicable legal requirements are met. In the event of errors, we will, upon notification, immediately correct our information about you. Personal data will be erased when the legal requirements are met.

Restriction of the processing: If the applicable legal provisions are met, you can require us to restrict the processing of your personal data. This means that your personal data will only be stored and not actively used anymore, unless you give consent for further use. Excluded from restriction are the personal data needed for the exercise or defence of legal claims.

Objection to the processing of data: Furthermore, you have the right to at all times object to the processing of your personal data by us. We will cease to process your personal data, unless we can demonstrate compelling legitimate grounds for further processing (according to the applicable legal provisions) that outweigh your objection rights. You can also choose at any time to stop receiving marketing communication from us. To do so, simply unsubscribe by clicking the designated button at the bottom of every marketing email.

Right to lodge a complaint with the supervisory authorities: You have the right to lodge a complaint with the supervisory authority. Therefore, you can contact the data protection authority that is competent for your place of residence.

5. Who will receive your personal data?

We rely on an EU-based Microsoft server to store the personal data outlined above.

In principle, we do not share your personal data with anyone other than the persons who work for us, as well as with the suppliers who help us process your personal data. Anyone who has access to your personal data will always be bound by strict legal or contractual obligations to keep your personal data safe and confidential.

We do not transfer your personal data outside the European Economic Area (EEA). We will only transfer your personal data outside the EEA if you or your employer have offices outside the EEA with which we need to communicate. If a transfer were to take place, we will take sufficient safeguards to protect your personal data during the transfer (e.g. by entering into an agreement based on standard data protection clauses approved by the European Commission).

ClauseBase reserves the right to amend this Privacy Statement from time to time.
